Dear Friends of STRACC,

 

Round One: STRACC PREVAILS!


As you all know, we have been working with STRACC's attorneys to lobby against adoption of the short-term rental regulations being proposed by Chelan County Community Development staff. We were successful in that effort! Due to our efforts the CC Planning Commission recommended against adoption of the regulations and the Chelan County Commissioners then declined to adopt the proposed regulations.
 

Round Two: The Fight is not Over!


The County staff has been tasked by the Commissioners with re-drafting the proposed regulations and coming back to the planning commission with another proposal. There has been discussion at both the planning commission and Board of Commissioners level of organizing a stakeholder group for input regarding the proposed regulations, but so far, we do not believe that County staff has started down that path yet. Your property rights and businesses are currently under siege by Chelan County. A recent Hearing Examiner’s decision has found short-term rentals to be ILLEGAL in parts of the County and we are fighting back!


Our Next Steps:


There are two legal matters of interest going before the Chelan County Superior Court:

One is to appeal the affirmation of an “administrative interpretation” of county code banning short-term rentals in a specific zoning district (a toe hold for all other districts).

The other is for civil claims and damages on behalf of all short-term rental owners in Chelan County, based on the new planning department and code enforcement staff's position that short-term rentals are illegal under current zoning codes. This is a complete about face by the County, and is obviously inconsistent with county codes, as well as previous determinations by the county that are still standing.
